Terms of Service
Welcome to EventHub
These Terms of Service became effective on September 1, 2010. Please review them carefully as they govern your use of our platform and services.
Right of Withdrawal for Consumers
If you are a consumer under applicable consumer protection laws, you have the right to cancel your participation in our Premium Service within 14 days without providing a reason. You may submit your cancellation in text form via mail, fax, or email.
The withdrawal period begins after you receive these terms in text form, but not before the contract is concluded, and not before we fulfill our legal obligations regarding consumer information.
To exercise your right of withdrawal, please send your cancellation notice to the address provided below. Simply sending the notice in time is sufficient to meet the deadline.
Consequences of Withdrawal
In case of valid withdrawal, both parties must return any received benefits. If you have already received services that cannot be returned or can only be returned in diminished condition, you may be required to provide compensation for their value. Payment obligations must be fulfilled within 30 days, starting from when you send your withdrawal notice.
Special Notice
Your right of withdrawal expires if the contract has been completely fulfilled at your express request before you exercised your withdrawal right. This occurs when your listing has been promoted with enhanced advertising features and your payment has been processed. Once we have fully delivered all contractually obligated services and you have completed payment, the contract is considered completely fulfilled.
§ 1 General Provisions
Welcome to EventHub's event discovery platform. We provide a comprehensive network that enables event organizers and advertisers to reach broader audiences through our interconnected portal system.
- EventHub operates internet-accessible databases where participants can submit event listings and search through published events using our provided search functionality. This search capability is available across all partner portals in our network.
- These Terms of Service apply exclusively to the relationship between EventHub and all participants who use our database services. Any conflicting terms from participants are not recognized.
- EventHub provides only the technical infrastructure for information transmission through our databases. We do not control the content of listings submitted by users. EventHub is not itself an event organizer or venue operator for any listed events.
§ 2 Service Description
- Our service consists of providing an input interface for event listings, activating submitted listings after review, and enabling public access to these listings through our internet databases. Listings are designed exclusively for promoting events or venues. All contractually obligated services are fulfilled when your listing becomes publicly accessible on at least one portal within our network.
- EventHub increases the reach of your submitted listings through various measures, including integration with additional websites, online and print media, and email notifications about events. By submitting content, you acknowledge that your listings may be displayed across multiple media channels.
- Access to EventHub's website and functionality is provided according to current technological standards.
- EventHub reserves the right to temporarily restrict the availability of listing submission or retrieval when necessary for capacity limits, server security, system integrity, or technical maintenance. We will consider the legitimate interests of all participants and provide advance notice whenever possible.
- Due to technical reasons, there may be temporary periods when published listings cannot be accessed due to unforeseeable system outages.
§ 3 User Accounts and Registration
- Using EventHub's platform requires registration. Registration is free of charge. Upon registration, a usage agreement is established between EventHub and the participant. There is no entitlement to contract formation.
- Registration is permitted only for legal entities, business partnerships, and fully legally competent natural persons. Minors are expressly prohibited from registering with EventHub.
- All information requested during registration must be provided completely and accurately. Registration requires a valid email address and the creation of a personal password. Your password must be kept confidential and not shared with third parties.
- Each participant may register only once with EventHub. Creating multiple user accounts simultaneously is not permitted. Circumventing this rule through the use of different data is prohibited. User accounts are non-transferable.
- EventHub reserves the right to delete user accounts that have been inactive for 12 consecutive months.
§ 4 Submitting and Extending Listings
- Each participant may submit an unlimited number of free listings on the EventHub platform simultaneously. However, you must verify that a listing does not already exist in our databases. You will be notified of potential duplicates during the submission process.
- Listings can generally be submitted free of charge. Additionally, you have the option to purchase promotional highlighting of your listing in relevant contexts. If you choose promotional highlighting, you pay the price generated in the advertising booking. You can freely select which target audience (region and portal), days, and promotion level you prefer. Pricing depends on portal reach and selected city. The Terms of Service and current price list at the time of submission determine the contract content and listing price.
- Listings remain in the database permanently. If you no longer want your listing displayed on EventHub network websites, you may delete it in your management area. Deletion of a listing does not entitle you to refunds for previously purchased Premium Services.
§ 5 Credit Account and Listing Fees
- Listings can generally be submitted free of charge. To purchase Premium Services, you must have credit in your account. Credit accounts can be funded via invoice or payment processor.
- If payment collection fails, the participant must reimburse EventHub for any resulting additional costs, unless the failure was not the participant's responsibility.
- Account credit is non-transferable and cannot be redeemed for cash.
§ 6 Vouchers
Vouchers allow you to add credit to your account using a voucher code. After entering the code, the voucher value is immediately credited to your account. Each voucher may only be redeemed once. Vouchers cannot be exchanged or redeemed for cash.
§ 7 Content Deletion, Suspension, Termination and Other Measures
- EventHub may take the following measures if there is concrete evidence that a participant violates legal requirements, third-party rights, or these Terms of Service, or if EventHub has another legitimate interest (particularly if payment collection fails):
- Deletion of listings or other content submitted to EventHub
- Delayed publication of content on the EventHub website
- Issuing warnings to participants
- Restricting or limiting use of the EventHub website
- Temporary suspension of participants
- Permanent suspension of participants
When selecting measures, EventHub considers the legitimate interests of affected participants, particularly whether evidence suggests the participant is not at fault for the violation.
- EventHub may delete listings if their content or presentation violates these Terms of Service, legal requirements, or third-party rights. In case of deletion by EventHub after Premium Services have been used, the participant remains obligated to pay for those Premium Services.
- EventHub may permanently ban a participant from using the platform if they repeatedly or seriously violate these Terms of Service, or if another significant reason exists.
- Once suspended, participants may no longer use the EventHub website and may not register again.
- Participants may terminate the usage agreement at any time by deleting their user account in the management area.
- EventHub may terminate the usage agreement at any time with 14 days' notice. This does not affect the right to suspension or extraordinary termination.
§ 8 Price Changes and Terms Amendments
- Price changes are announced through updates to the internet-accessible price list, indicating the effective date of changes. New prices apply to listings newly submitted or extended from the change date forward. Existing listings at the time of price changes continue under previous conditions.
- EventHub reserves the right to modify these Terms of Service at any time without stating reasons. Modified terms will be presented to participants before submitting or extending listings. You must agree to the new Terms of Service to submit new listings. Administrative access to your user account and management of existing listings remains available even without agreement to new terms. If you do not agree to new Terms of Service, you may delete your user account at any time.
§ 9 Content and Presentation Requirements
- By submitting content, participants grant EventHub an unlimited usage right to that content and confirm they possess the necessary rights. Participants receive no compensation for this. This usage right expires when the participant deletes the content.
- When participants delete content, the usage right terminates.
- Participants must submit listings only in their designated categories. Only listings promoting events or venues that do not violate any laws or third-party rights are permitted. Participants are solely responsible for listing content.
- When submitting a listing, participants must verify whether it already exists in the database. Duplicate listings are not permitted. If a similar listing exists that requires correction, editing rights can be requested using the "This is my event/venue" function on the listing detail page.
- Listings may include images. Participants commit to submitting only images they have unrestricted rights to use and that are not encumbered by third-party rights, particularly copyrights.
- Premium-rate telephone numbers, particularly in the 0900 range, that result in elevated charges for callers are not permitted.
§ 10 Responsibility for Listing Content
- Participants must provide complete and truthful information regarding their listings (particularly title, date, and location). Inadvertently incorrect information (such as typos or incorrect category placement) must be corrected immediately upon discovery. EventHub does not verify the accuracy or completeness of listing content. EventHub provides no warranty regarding the accuracy or completeness of listings.
- EventHub excludes all warranties and liability regarding whether listings comply with legal requirements.
§ 11 Indemnification
Participants indemnify EventHub against all claims that third parties assert against EventHub due to infringement of their rights through the participant's listing or other use of the EventHub website. This includes costs of necessary legal defense, including all court and attorney fees. This does not apply to the extent that the rights violation was not the participant's responsibility.
§ 12 Database Currency, Content Management, Backups
To make event discovery as interesting and successful as possible, EventHub strives to maintain current data. Changes to listings are implemented in real-time and are immediately visible on the internet.
§ 13 Search Manipulation and System Integrity Disruption
- Participants may search listings in EventHub databases only through the search interfaces provided by EventHub. Searching while bypassing search interfaces is prohibited, particularly through the use of search software that accesses EventHub databases directly.
- Activities intended to render the EventHub website inoperable or impede its use are prohibited. Participants may not take measures that could result in unreasonable or excessive burden on EventHub's infrastructure. Participants may not block, overwrite, or modify content generated by EventHub, or otherwise interfere with the EventHub website.
- Participants are prohibited from manipulating EventHub search results through false or misleading information, incorrect category placement, technical measures, or other abuse of EventHub website functionality.
§ 14 Warranty
EventHub is exempt from performance obligations in cases of force majeure. Force majeure includes all unforeseeable events and those whose effects on contract fulfillment are not attributable to either party. These events include lawful labor disputes (including at third-party companies), governmental measures, communication network and gateway failures of other providers, other technical disruptions (even when occurring with subcontractors, sub-suppliers, or their subcontractors, or with operators of sub-accounting computers authorized by EventHub). Participants have no claims for disruptions not attributable to EventHub.
§ 15 Limitation of Liability
- Toward businesses, EventHub is liable for damages (except in cases of breach of essential contractual obligations) only if and to the extent that EventHub, its legal representatives, managerial employees, or other agents are guilty of intent or gross negligence. In cases of breach of essential contractual obligations, EventHub is liable for any culpable conduct of its legal representatives, managerial employees, or other agents.
- Toward consumers, EventHub is liable only for intent and gross negligence. In cases of breach of essential contractual obligations, debtor default, or impossibility of performance attributable to EventHub, EventHub is liable for any culpable conduct of its legal representatives, managerial employees, or other agents.
- Except in cases of intent and gross negligence by legal representatives, managerial employees, or other agents, EventHub's liability is limited to damages typically foreseeable at contract formation.
- Liability for indirect damages, particularly lost profits, exists only in cases of intent or gross negligence by legal representatives, managerial employees, or other agents of EventHub.
- The aforementioned liability exclusions and limitations toward businesses or consumers do not apply if EventHub has provided explicit guarantees.
§ 16 Copyright and Usage Rights
All data, information, trademarks, texts, programs, and images in listings submitted to the EventHub website are subject to copyright protection. Modification, further processing, and use in any media by third parties is not permitted. Participants' rights remain unaffected. Participants retain free disposition over their own data and information.
§ 17 Place of Performance, Applicable Law, Jurisdiction
- Where the participant is a business, the usage agreement including these Terms of Service is subject exclusively to the laws of the applicable jurisdiction in application and interpretation.
- Where the participant is a consumer, the usage agreement including these Terms of Service is subject to applicable law to the extent that no mandatory legal provisions, particularly consumer protection provisions, conflict.
- If the participant is a merchant within the meaning of commercial law, the exclusive jurisdiction for all disputes arising from and related to use of EventHub databases is as specified by applicable law. The same applies if the participant relocates their residence abroad after contract formation or has no general jurisdiction within the applicable territory.
- For participants who are consumers, jurisdiction exists at the participant's respective residence. For all disputes arising from the usage agreement and these Terms of Service, additional jurisdiction for consumers is available as specified by applicable law.
§ 18 Severability Clause
If any provision of these Terms of Service is invalid, the remaining provisions remain unaffected. The invalid provision is deemed replaced by one that comes closest economically to the purpose and intent of the invalid provision in a legally valid manner. The same applies to any regulatory gaps.
